MICHAEL A. RICHARD is an Associate in the Federal Contracting Group and focuses his practice on government contracts litigation, in particular, drafting, negotiating, and litigating claims under the Contract Disputes Act. He represents a variety of government contractors including construction contractors, design-builders, designers, suppliers, IT contractors, and environmental remediation contractors.

As an experienced trial lawyer, Michael regularly practices before the Armed Services Board of Contract Appeals, the Civilian Board of Contract Appeals, and the Court of Federal Claims. He litigates claims for delay, disruption, differing site conditions, design defects, overzealous inspection, negligent estimation of quantities, changes to design criteria, withholding of liquidated damages, and contract terminations. Michael also represents clients in bid protest actions before the Court of Federal Claims and the Government Accountability Office. Throughout his career, he has represented clients in alternative dispute resolution procedures with the federal government and successfully negotiated multi-million dollar settlements with numerous federal agencies.

Michael also helps the Firm’s contractor clients resolve issues with subcontractors including pass-through claims, prompt payment requirements, prevailing wage issues, and Miller Act bond claims. He advises his small business clients with Small Business Administration protests, teaming agreements, and helps them maintain status as an SDVOSB, WOSB, or other federally recognized small business. Michael also counsels clients regarding compliance with the FAR, the False Claims Act, the Buy American Act, and other federal regulations.
