Top Ten Reasons Why Employers Lose Retaliation Cases
When making termination decisions, many employers make the mistake of blindly relying on “at-will” employment policies at their peril. Did you know that an employee can prevail on a retaliation claim even if his or her underlying claim of discrimination is found to be completely baseless? There are many circumstances where firing an employee without proper precautions has serious negative consequences. Termination decisions must be made carefully with plenty of documentation and consideration of all the circumstances. In this session we will cover the top ten reasons why employers lose retaliation cases and strategies that can help you avoid retaliation claims.

It’s Junior High All Over Again: Bullying and Puppy Love in the Workplace
If you are an owner or manager, and feel like you are stuck in a bad 80s romantic- drama when you are at work, you are not alone. Workplace claims for bullying and harassment are on the rise. Traditional boundaries that define relationships between employees and supervisors and between employees continue to shift. Technology and the wide-spread adoption and use of social media have complicated matters further. In this session, we will share the basics and ground rules needed to protect you and your business including, encouraging and enforcing appropriate workplace culture, establishing confidential complaint and resolution procedures, work policies that are your best defense to litigation and the latest on harassment and anti bullying legislation and the potential impact to your business.

Workplace Investigations: What You Don’t Know Can Hurt You
The need for an internal investigation can arise in a number of circumstances. Internal investigations may be necessary to discover the existence of discriminatory employment practices, to determine the source of loss caused by fraud, or to uncover weaknesses in corporate structures. The questions of when and how to conduct an internal investigation can be difficult to answer and mistakes in the investigation process can lead to long-term negative impacts. In this session, we will explain the lifecycle of corporate investigations including appropriate personnel, electronically stored information, attorney-client privilege, investigation reports and common missteps.

Our interactive panel will cover the most significant developments in labor and employment law in 2014, including Supreme Court rulings, what seems to be an out-of-control NLRB, new regulations, and legislation at the federal and state levels on issues affecting every employer. This year our panel discussion will feature a Q&A for the panelists and we will be taking questions from you! Submit your panel questions to Elizabeth Catterall at We look forward to providing answers and having a spirited debate of the issues and the hot topics on the horizon in 2015.
