Teaming is a concept much discussed in the world of federal contracting, yet it is often misunderstood. Before you enter into your next teaming agreement, make it a point to understand the rules and what must be contained in your teaming agreement to make it an effective, enforceable document. We explored the importance of well-crafted scopes of work, exclusivity, indemnity and other key parts of a teaming agreement, as well as how the murky world of teaming agreements is viewed by courts of various jurisdictions. Also, while there is, in fact, no “I” in team, that does not mean that a teaming agreement should not be negotiated. As part of our discussion, we considered the practical implications of negotiating terms of a teaming agreement from the both the prime and subcontractor perspectives.
