On June 28, Lane Kelman and Jennifer Budd presented “Liability in Green Building” for USGBC Central Pennsylvania.
This session used actual cases to identify issues that have caused litigation in past green building construction projects. The program also explained how different parties (designers, contractors, suppliers, and owners) can prevent similar situations going forward. It helped the attendees prepare themselves through effective contracting and project management, including through an explanation of the 2017 AIA Green Building rider. Additionally, the program provided information for attendees to develop procedures that reduce liability when undertaking green building construction. The best defense to a lawsuit is to be aware of pitfalls and to proactively implement preventative measures to liability. This program applied this strategy to the unique issues that arise in green building such as efficiency performance, tax and governmental incentives, ability to achieve certifications such as LEED, loss of profit or revenue, etc.
