This session will use actual cases to identify issues that have caused litigation in past green building construction projects. The program will also explain how different parties (designers, contractors, suppliers, and owners) can prevent similar situations going forward. It will help the attendees prepare themselves through effective contracting and project management, including through an explanation of the 2017 AIA Green Building rider. Additionally, the program will provide information for attendees to develop procedures that will reduce liability when undertaking green building construction. The best defense to a lawsuit is to be aware of pitfalls and to proactively implement preventative measures to liability. This program will apply this strategy to the unique issues that arise in green building such as efficiency performance, tax and governmental incentives, ability to achieve certifications such as LEED, loss of profit or revenue, etc.
