Risky Business:
Independent Contractor or Employee?

As employers seek to outsource a greater share of their work to independent contractors, they hope to benefit from certain employment and tax law benefits, including limitations on EEO liability, workers' compensation and unemployment compensation as well as no employment tax obligations. However, those benefits are not nearly as categorical or extensive as widely believed. This hot button issue has gained national attention and now has taken on a local importance here in Pennsylvania with the passing of House Bill 400, signed into law by former Governor Ed Rendell. The new law established the Construction Workplace Misclassification Act which went into effect on February 10, 2011. It will have a dramatic impact on all construction companies utilizing independent contractors directly, or through a subcontractor.
