Insurance Coverage & Risk Management
Our Insurance Coverage & Risk Management Group provides policyholders with the resources they need to properly manage risks, avoid claims, and, if necessary, successfully litigate to obtain coverage. Our attorneys regularly evaluate and manage insured and non-insured business risks for our clients, including analyzing those associated with various contractual clauses, such as indemnification provisions and insurance requirements. We also work with our clients to develop prudent risk management programs to minimize uninsured claims.
When a claim is necessary, we help policyholders minimize the risk of denials and negotiate with insurance carriers to trigger coverage. Once the carrier has agreed to defend the litigation, we monitor the proceedings to ensure that counsel appointed by the insurance carrier properly defends the claim and acts in the best interests of our client. If negotiations fail, we litigate to obtain coverage. Our attorneys understand the complex issues at play in insurance coverage matters as they have experience on both sides of the table, defending clients in actions brought by insurance companies to deny coverage and prosecuting actions on behalf of clients seeking to obtain coverage. Our goal is to ensure there is coverage available to pay for the settlement, or the verdict, if the underlying case is tried.
While we represent policyholders across a wide variety of industries in these matters, we are particularly well suited to represent clients in the construction industry.
