When reviewing contacts, contractors often focus on work scope because they believe other provisions are difficult to negotiate or are fixed. However, all contracts are subject to negotiation. Even contract provisions that are fixed require attention, especially those that govern the timing of payment, change order requests, additional work directives, monthly releases, claims, delays, and conditions precedent to termination. These other terms, while not explicitly discussing payment, are essential to knowing and protecting your rights and may have a major impact on how and when you get paid.
