Service and assistance animals are getting more and more prevalent in our communities. The laws governing these animals’ presence in communities are not terribly complicated. But, more and more Associations are getting caught misapplying the rules. Violating a disabled person’s rights can be an extremely expensive error. In this session, Steve Williams, an attorney who has been defending disability claims under fair housing laws and the Americans with Disabilities Act for almost 27 years, discussed the obligations an Association has with regard to service and assistance animals, including:
- What constitutes a service animal
- How a service animal is different than an assistance animal
- When, how and if Associations can restrict service and assistance animals
- How the fair housing laws and the ADA govern the decisions that Associations can make regarding them
- How Associations can avoid the liability trap when dealing with disabled residents
