Federal contracting can be complicated, and federal subcontracting can be even more so. Whether you are a prime or a subcontractor, success will depend on your ability to successfully navigate subcontracting in the federal sphere. In this session, Timothy Furin and Casey McKinnon covered the essential issues that prime contractors and subcontractors must keep in mind when negotiating and drafting subcontracts for use on federal projects. They discussed FAR flow-downs and other critical provisions including disputes and payment clauses. They also explained how to navigate the pass-through claim process and the negotiation of liquidating agreements. Finally, they discussed a very particular type of subcontracting: teaming. Guests learned about the essential provisions and issues that should be addressed when teaming to win federal contracts.
