- Defended an HVAC contractor in a $14 million geothermal retrofit project for a New Jersey school district. The General Contractor asserted a multi-million dollar claim against the HVAC contractor, claiming that defective work resulted in system operation issues and delayed completion. After 6 days of AAA arbitration, the HVAC Contractor received a defense award on the General Contractor’s claims and an award of approximately 90% of its counterclaim. The client was awarded costs and attorney’s fees when the General Contractor objected to the reduction of the arbitration award to a judgment in the New Jersey Chancery Court.
- Represented plaintiffs in an improper investigation, defamation, and wrongful termination lawsuit, lasting five weeks and resulting in a sizeable settlement for the clients.
- Assisted a mid-sized manufacturing company through a unionization campaign, initial union election, and negotiated the union contract.
- Implemented training protocols for management regarding appropriate unionization avoidance strategies and avoidance of unfair labor practices claims.
- Drafted a Petition for Certiorari that was granted by Pennsylvania Supreme Court and drafted brief
- Represented a developer against claims brought by a homeowners’ association for construction defects, settling for a fraction of the amount of damages claimed by the associations’ expert witnesses.
- Defended a prominent restaurant chain in a race and gender discrimination action that resulted in a defense verdict in under an hour after a five day jury trial.
- Secured H1-B visas for high-level software development recruits for a software technology company
- Obtained a successful settlement on behalf of 12 female/minority clients in a discrimination suit against a major, multi-national corporation immediately before trial
Sally is a focused and creative litigator with a keen business judgment honed over three decades of representing small and medium-sized businesses throughout the Mid-Atlantic region. Clients turn to her for guidance in creditor’s rights, business disputes, employment law, and contract negotiation and interpretation. Sally prides herself on providing sound, executive-level advice to business clients, helping them to avoid litigation whenever possible and positioning them for the best possible outcome when litigation cannot be avoided. She is an aggressive but practical litigator and focuses on furthering her client’s goals from start to finish.
Sally handles complex cases from inception through trial and appeals. She assists a wide variety of secured and unsecured creditors in protecting their claims before and in bankruptcy. Sally has successfully litigated adversary proceedings, preference actions, fraudulent transfer claims and objections to the amount, validity, priority and security of claims in the bankruptcy courts in Delaware, Pennsylvania and New Jersey. She is admitted to practice in the state and federal courts of Delaware, Pennsylvania, New York, and New Jersey and has appeared before the Second and Third Circuit Courts of Appeals, the Pennsylvania Superior Court, and the Pennsylvania Commonwealth Court.
