Law360, New York (March 29, 2017, 6:15 PM EDT) — The New Jersey Appellate Division on Wednesday affirmed the state Department of Environmental Protection’s award of a nearly $30 million Superstorm Sandy restoration project contract, ruling that the agency had properly rejected an unsuccessful bidder’s contention that the winner didn’t have the qualifying experience.
The two-judge panel’s opinion dealt a blow to Agate Construction Co. Inc., which argued that winning bidder J. Fletcher Creamer & Son Inc. hadn’t demonstrated prior experience in projects adjacent to a beach or inlet, which the DEP had said was required to repair a sea wall in the borough of Sea Bright that was destroyed during the October 2012 storm.
