On March 29, 2021, the Centers for Disease Control and Prevention (CDC) extended the current eviction moratorium through June 30, 2021. If a tenant previously provided a signed declaration to the landlord and/or property owner invoking the protections of the CDC eviction moratorium, the tenant remains protected and is not required to resubmit a new declaration. Additionally, in contrast to the practice under the prior extensions, tenants may gain the protection of the moratorium by providing their landlords with a signed writing including the requisite declaration information, and are no longer required to use the declaration form previously required.
While the extension permits evictions for, among other things, a tenant’s criminal conduct while in the leased premises, evictions are not permitted where the criminal activity at issue is an alleged trespass (or similar state law offenses) for remaining in the property without having paid rent.
We will continue to monitor the federal government’s actions regarding the CDC eviction moratorium and provide updated information when available.
