A federal appeals court has temporarily enjoined the April 30, 2012 deadline for employers to post the Notice of Employee Rights under the National Labor Relations Act. The U.S. Court of Appeals for the District of Columbia recently ordered that the National Labor Relations Board’s (“Board”) rule containing the new posting requirement would be put on hold while the case is pending before the Court of Appeals.
As of this date, the Board has not set a new deadline for posting the notices. The Board has announced that it will not implement any part of the rule while the appeal is pending. Additional information about the Board rule and pending court challenges is available here. We will continue to follow this issue and keep our clients apprised of significant developments.
