This sample application for relief under the Equal Access to Justice Act was submitted on behalf of a subcontractor in a situation where the claim was settled before trial. Recovery under the Act does not require litigation provided that the other requirements of Act (i.e., “prevailing party, size requirements, etc.) are met. The referenced “interim regulations” are still in effect.
