Litigating Disputes
The litigation of contract disputes, which involves the appeal of an adverse contracting officer’s decision to a board of contract appeals, or the United States Court of Federal Claims, is time-consuming and expensive. Contractors are well advised to consider the litigation risk of proceeding with an appeal and should do everything possible to negotiate a settlement of the dispute. In this regard, Alternate Dispute Resolution, and Partnering should be given priority consideration.
