    Poor Workmanship

    The government has the burden of proof if it seeks to establish that the contractor was guilty of poor workmanship. The government must show that the standard of performance of the contractor was below that demonstrated by other similar contractors performing comparable projects. In response, the contractor should assert its reputation for quality work and should attempt to show that what appears to be defective work is actually the result of defective specifications, unreasonable government requirements, or application of unspecified testing or inspection requirements.
