Unilateral Change Order
A unilateral change order, or modification, is one which is issued by the contracting officer without requiring the consent or signature of the contractor. It is a one-sided directive to perform and although a contractor must abide by a unilateral directive, he is free to file a claim for the additional costs or time incurred. Since a unilateral change order does not require the contractor’s signature, the change order cannot act as, or contain, a release of further claims. (See FAR 43.103 (b)).
