    Request For Time Extension

    Many contracts now incorporate specifications that require the contractor to use computerized critical path method scheduling (CPM). Those specifications normally require time extension requests to include supporting computer analyses and other detailed information. A contractor may need to check the pertinent specification sections for specific requirements.

    It should also be noted, as recognized by the court, in Sterling Millwrights. Inc. v. United States, 26 Cl. Ct. 49, 77 (1992), CPM schedules and analyses are “pliant principles of construction management and lend themselves easily to different interpretation.” Moreover, as the case law readily demonstrates, CPM schedules are subject to manipulation and distortion and, therefore, must satisfy certain standards before they may be used to prove or disprove a delay claim. See generally George Sollitt Const. Co. v. United States, 64 Fed. Cl. 229, 240 (2005).
